Terms of Business

These terms and conditions (any quotation, order confirmation, invoice, or statement by His Glassworks, Inc.) are in effect as of January 1, 2012. Terms are subject to change without notice. Conditions not specifically stated herein shall be governed by established trade customs.

General Terms
• All prices are quoted in U.S. Dollars.  
• Prices are subject to change without notice. Please check our web site for the most up to date pricing on all items.
• All prices, terms and quotes are binding when approved in writing.
• Written quotes expire sixty (60) calendar days from date of issuance.
• All orders constitute a binding contract between the seller (His Glassworks, Inc.) and the buyer when seller releases shipment.
• Title to all goods transfers to the buyer at the FOB point.
• Invoices are attached to shipments originating from His Glassworks, Inc. facility unless otherwise requested.
     • If no invoice is found with the shipment, buyer should notify His Glassworks, Inc. immediately and a second copy will be issued.
     • Invoices for items that are drop shipped from other plants will be mailed from His Glassworks, Inc.
• Unless otherwise expressly agreed, His Glassworks, Inc. may make delivery in one or more installments with each installment
being treated as a separate agreement. Individual items from a single purchase order may be drop shipped from multiple suppliers.
 
Clerical Errors & Waiver
• His Glassworks, Inc. is not liable for clerical errors and may be corrected at any time.
• His Glassworks, Inc. is not liable to buyer for loss, damage, detention or delay resulting from causes beyond its reasonable control.  

Production Scheduling and Customer Order Cancellations (Delivery Policy)
• His Glassworks, Inc. produces all Diamond Disks and smoothing pads to order. A production time of three to four weeks is usually required for filling and shipping diamond disk orders.
• Purchase orders for items confirmed to be in stock will normally be shipped the same day providing the order is received by 11:30 AM EST. Orders received after 11:30 AM EST will be shipped the following day. When an item is not in stock, His Glassworks, Inc. will provide its best estimate on inbound shipments and production lead-time.
• A minimum cancellation charge of 10% of order value may be applied to any order cancellation occurring forty-eight (48) hours or more following receipt of order.

Rush Charges
• His Glassworks, Inc. fills orders in the sequence in which they are received. If you require a special rush to expedite your order which interrupts that schedule, an additional rush charge of 10% will be added to the base price of the total order cost.      

                                       
Payment
• The buyer agrees to pay each invoice due according to its terms. Payments should be made to:

• The following are standard terms of payment: prepayment (proforma), C.O.D. (Cash On Delivery), MasterCard, Visa, Discover, American Express, PayPal, Google Checkout  or net due within thirty (30) days from the date of invoice (NET30). NET 30 terms are subject to credit approval.  
• Payment is accepted as follows:
    • Checks: Personal and company checks must be drawn on a US bank and payable in US funds. A $25.00 fee will be charged for returnedchecks. PayPal service and Google Checkout service are also accepted.
    • Credit Card: MasterCard, Visa, Discover, American Express are accepted credit cards. Please include card number, expiration date, CVV2 code, name on the card, billing address and phone number accompanied with the signature of the cardholder. His Glassworks, Inc. maintains confidential hold of all data in its computer system.
    • International Payment: Prepay with either US bank money order, credit card, PayPal or Google Checkout. (See International Orders below).
• Any taxes, duties, VAT or tariffs imposed with sale of products which His Glassworks, Inc. either pays or must collect at any time, shall be added to and paid as part of the purchase price.
• His Glassworks, Inc. gladly extends credit terms to accounts with satisfactory credit ratings. Extensions of credit offered to buyer may be changed or withdrawn at any time.
• To obtain NET 30 terms from His Glassworks, Inc., buyer must provide company information along with three references with whom business has been done for over one year on a credit terms basis. Credit will not be extended without trade references including phone number and contact name. Download a credit application from the web at: http://www.hisglassworks.com/files/net30app.pdf.
• If buyer’s account is in arrears, His Glassworks, Inc. shall have the right, in addition to all other legal remedies and without prejudice to any other rights, to defer further deliveries until full payment is received. Receipt of payment, whether full or partial, shall in no way obligate His Glassworks, Inc. to extend further credit.
• NET 30 terms require that payment be received by His Glassworks, Inc. within 30 days from ship date, which is noted as invoice date.
• Extensions of credit for over 30 days are subject to a 1.5% per month finance charge, which will be added to the total overdue. Any unpaid finance charges will be added to the Receivables account and accrued monthly until paid in full. Failure to remit finance charges will cause the account to revert to C.O.D. status.
• Accounts with invoices over 60 days past due (90 days from the ship date) will automatically revert to C.O.D. status for one year.
• All orders shipped to North Carolina addresses are charged applicable NC sales tax rate (currently 7.75%).

International Orders
• Mail, fax, or E-mail orders to His Glassworks, Inc. A confirmation of receipt will be forwarded to buyer within one business day. If a confirmation of  receipt is not received, buyer should resubmit the purchase order to His Glassworks, Inc. to insure processing of the order. When requested, His Glassworks, Inc. will calculate and fax or E-mail the subtotal of the merchandise and comparison shipping charges when the order is prepared to be shipped. Buyer should then choose the preferred means of shipping, add shipping costs to the subtotal of estimate and notify His Glassworks, Inc. by phone, fax, or E-mail, regarding preferred shipper and chosen method of payment.
• His Glassworks requires pre-payment in full by either US bank money order, MasterCard, Visa, Discover or American Express prior to shipment unless other terms have been approved by His Glassworks, Inc. Paypal payments are also accepted.
    
Shipping Policy/Shipping and Handling Costs
• Shipping within the United States will be Ground, Next Day, Second Day and Three Day shipping via UPS (United Parcel Service). Overnight, Second Day, Saver and Ground shipping is also available via FedEx (Federal Express), and USPS Priority Mail when requested. All shipping, insurance and related charges will be paid by the buyer and are billed at cost.
• Shipment notification is available when shipping via UPS, Fed-Ex and USPS if an E-mail address is provided.    
• No packing fee or handling fee is charged, unless special crating is required.
• Delivery dates mentioned in any agreement are approximate and His Glassworks, Inc. is not liable to buyer for failure to deliver on any particular date or dates.
• Purchase orders for items confirmed to be in stock will normally be shipped the same day providing the order is received by 11:30 AM EST. Orders received after 11:30 AM EST will be shipped the following day. When an item is not in stock, His Glassworks, Inc. will provide its best estimate on inbound shipments and production lead-time.
• Reports of damaged goods or shortages should be made to His Glassworks within 5 days of receipt of goods. If merchandise is damaged as a result of carrier's mishandling, all packing material must be retained for inspection by carrier. His Glassworks, Inc. will respond as quickly as possible to provide replacement pieces. Credit to buyer’s account will be applied only after receipt of the approved damage claim form from the carrier.

Limited Warranty
• His Glassworks, Inc. warranty is for goods proven faulty by reason of inherently defective material or inferior workmanship for 90 days from date of shipment. Faulty goods must be returned to His Glassworks, Inc. within the 90 days warranty period. Buyer shall properly package and return the faulty merchandise for inspection by His Glassworks, Inc., which shall, at its option and without charge, repair or replace the goods shown to be defective.
• The warranty shall not operate where goods have been subject to use beyond their normal performance specifications, negligence, physical alteration of goods, or any other misuse.
• The warranty may be prorated, at the discretion of the His Glassworks, Inc., if the goods have been used excessively beyond the time of discovery of said fault.
• His Glassworks, Inc.’s liability in respect of goods subject to a separate warranty by the manufacturer of same goods will be limited to the manufacturer’s own warranty terms and conditions.

Refund and Return Policy
• Materials returned for credit, or refund, must be in “as purchased” condition and returned within 30 days of purchase. Prior approval by His Glassworks, Inc. is required for proper credit.  
• If items are returned to His Glassworks due to buyer’s error in ordering, there will be a 15% restocking charge for each item returned after purchase.
• A written request for return of saleable items must be submitted via mail, fax, or E-mail and must include the following information: Date of  purchase, product description, invoice reference number and reason for return.
• A Returned Merchandise Authorization (RMA) number will be issued by His Glassworks, Inc. for approved returns, and must be displayed on all packaging and return documentation. Goods without an RMA number will not be accepted and may be returned.
• Non stock, custom made, discontinued or altered products are not returnable.
• Cost of return shipping charges for authorized returns are to be prepaid by buyer.
• Costs incurred by shipment refusal or buyer error are assumed by buyer.
• Any item purchased by credit card and returned after 120 days will result in credit on customer account and will not be refunded to credit card.
Returns due to Error or Damage
• If an item is shipped in error by His Glassworks, Inc., or if an item shipped is defective (see Limited Warranty section above), no restocking fee will be charged. Such errors must be reported within 5 days of receipt of goods.
• His Glassworks, Inc. will then issue a “CALL TAG”  for the prepaid return to His Glassworks, Inc.
• Credit for returned merchandise will not be issued until the goods are received and inspected by His Glassworks, Inc.

Privacy Policy

His Glassworks, Inc. may collect personally identifiable information including name, address, email, IP address and shopping history when visitors come to our site. This information is held in the strictest confidence and is not sold to any other individual or corporation.

Security Policy

Your personal and payment information is always safe. Our website utilizes Secure Sockets Layer (SSL), which is the industry standard for secure commerce transactions. It encrypts all of your personal information, including credit card number, name, and address so that it cannot be read over the internet. Additionally, all personal information is stored in an encrypted database.

Business Hours
• His Glassworks, Inc.’s hours of business are 8:30 AM to 4:30 PM EST Monday through Friday with lunch hour from 12:00 PM to 1:00 PM. His Glassworks is closed on Saturday and Sunday.
